display: flex; flex-flow: row nowrap; margin-bottom: 10px;" powered-by="xiumi.us"><section style="display: inline-block;width: 100%;vertical-align: top;align-self: flex-start;flex: 0 0 auto;background-color: rgb(246, 248, 247);border-style: solid;border-width: 2px;border-color: rgb(93, 91, 92);box-shadow: rgb(255, 255, 255) -7px 7px 0px 0px inset;padding: 23px;"><section style="text-align: center;font-size: 17px;" powered-by="xiumi.us"><p><strong>法条链接</strong></p></section><section style="text-align: justify;" powered-by="xiumi.us"><p><br></p></section><section style="text-align: justify;" powered-by="xiumi.us"><p style="text-indent: 2em;text-wrap: wrap;"><strong>《中华人民共和国刑法》</strong></p><p style="text-indent: 2em;text-wrap: wrap;">第三百四十条违反保护水产资源法规，在禁渔区、禁渔期或者使用禁用的工具、方法捕捞水产品，情节严重的，处三年以下有期徒刑、拘役、管制或者罚金。</p><p style="text-indent: 2em;text-wrap: wrap;"> </p><p style="text-indent: 2em;text-wrap: wrap;"><strong>《最高人民检察院、公安部关于公安机关管辖的刑事案件立案追诉标准的规定（一）》</strong></p><p style="text-indent: 2em;text-wrap: wrap;">第六十三条［非法捕捞水产品案（刑法第三百四十条）］违反保护水产资源法规，在禁渔区、禁渔期或者使用禁用的工具、方法捕捞水产品，涉嫌下列情形之一的，应予立案追诉：</p><p style="text-indent: 2em;text-wrap: wrap;">（一）在内陆水域非法捕捞水产品五百公斤以上或者价值五千元以上的，或者在海洋水域非法捕捞水产品二千公斤以上或者价值二万元以上的；</p><p style="text-indent: 2em;text-wrap: wrap;">（二）非法捕捞有重要经济价值的水生动物苗种、怀卵亲体或者在水产种质资源保护区内捕捞水产品，在内陆水域五十公斤以上或者价值五百元以上，或者在海洋水域二百公斤以上或者价值二千元以上的；</p><p style="text-indent: 2em;text-wrap: wrap;">（三）在禁渔区内使用禁用的工具或者禁用的方法捕捞的；</p><p style="text-indent: 2em;text-wrap: wrap;">（四）在禁渔期内使用禁用的工具或者禁用的方法捕捞的；</p><p style="text-indent: 2em;text-wrap: wrap;">（五）在公海使用禁用渔具从事捕捞作业，造成严重影响的；</p><p style="text-indent: 2em;text-wrap: wrap;">（六）其他情节严重的情形。</p><p style="text-indent: 2em;text-wrap: wrap;"> </p><p style="text-indent: 2em;text-wrap: wrap;"><strong>《中华人民共和国渔业法》</strong></p><p style="text-indent: 2em;text-wrap: wrap;">第三十条禁止使用炸鱼、毒鱼、电鱼等破坏渔业资源的方法进行捕捞。禁止制造、销售、使用禁用的渔具。禁止在禁渔区、禁渔期进行捕捞。禁止使用小于最小网目尺寸的网具进行捕捞。捕捞的渔获物中幼鱼不得超过规定的比例。在禁渔区或者禁渔期内禁止销售非法捕捞的渔获物。</p><p style="text-indent: 2em;text-wrap: wrap;">重点保护的渔业资源品种及其可捕捞标准，禁渔区和禁渔期，禁止使用或者限制使用的渔具和捕捞方法，最小网目尺寸以及其他保护渔业资源的措施，由**渔业行政主管部门或者省、自治区、直辖市人民政府渔业行政主管部门规定。</p><p style="text-indent: 2em;text-wrap: wrap;">第三十八条使用炸鱼、毒鱼、电鱼等破坏渔业资源方法进行捕捞的，违反关于禁渔区、禁渔期的规定进行捕捞的，或者使用禁用的渔具、捕捞方法和小于最小网目尺寸的网具进行捕捞或者渔获物中幼鱼超过规定比例的，没收渔获物和违法所得，处五万元以下的罚款；情节严重的，没收渔具，吊销捕捞许可证；情节特别严重的，可以没收渔船；构成犯罪的，依法追究刑事责任。</p><p style="text-indent: 2em;text-wrap: wrap;">在禁渔区或者禁渔期内销售非法捕捞的渔获物的，县级以上地方人民政府渔业行政主管部门应当及时进行调查处理。</p><p style="text-indent: 2em;text-wrap: wrap;">制造、销售禁用的渔具的，没收渔具和违法所得，并处一万元以下的罚款。</p><p style="text-indent: 2em;text-wrap: wrap;"> </p><p style="text-indent: 2em;text-wrap: wrap;"><strong>《福建省实施<中华人民共和国渔业法>办法》</strong></p><p style="text-indent: 2em;text-wrap: wrap;">第三十九条禁止炸鱼、毒鱼、电鱼，禁止使用鱼鹰、鱼簖、目鱼笼捕鱼和敲舟古作业。</p><p style="text-indent: 2em;text-wrap: wrap;">禁止制造、维修、销售、随船携带、使用禁用的渔具以及不符合规格标准的渔具。</p><p style="text-indent: 2em;text-wrap: wrap;">第五十五条违反本办法第三十九条规定，使用禁用的渔具、不符合规格标准的渔具、破坏渔业资源的捕捞方法进行捕捞的，没收渔获物和违法所得，并按照下列规定分别处以罚款：</p><p style="text-indent: 2em;text-wrap: wrap;">（一）炸鱼、毒鱼、电鱼的，在内陆水域处五千元至二万元的罚款；在海洋处三万元至五万元的罚款；</p><p style="text-indent: 2em;text-wrap: wrap;">（二）敲舟古作业的，处一万元至三万元的罚款；</p><p style="text-indent: 2em;text-wrap: wrap;">（三）使用鱼鹰、鱼簖、目鱼笼捕鱼的，处一千元至五千元的罚款；</p><p style="text-indent: 2em;text-wrap: wrap;">（四）在内陆水域随船携带、使用禁用渔具或者不符合规格标准的渔具进行捕捞的，处二千元至一万元的罚款；</p><p style="text-indent: 2em;text-wrap: wrap;">（五）在海洋随船携带、使用禁用渔具或者不符合规格标准的渔具进行捕捞的，处三万元至五万元的罚款。</p><p style="text-indent: 2em;text-wrap: wrap;">有前款规定的行为，情节严重的，没收渔具、吊销捕捞许可证；情节特别严重的，可以没收渔业船舶；构成犯罪的，依法追究刑事责任。</p><p style="text-indent: 2em;text-wrap: wrap;">制造、维修、销售禁用的渔具或者不符合规格标准的渔具的，没收渔具和违法所得，并处二千元至一万元的罚款。</p></section></section></section><p style="outline: 0px;
